Description
संविधान की मूल संरचना। पाठ्यक्रम भारत के संविधान की मूल संरचना के बारे में बोलता है। यह बताता है कि कैसे इसे शंकरी प्रसाद मामले, गोलखनाथ मामले और केशवानंद भारती मामले जैसे मामलों की एक श्रृंखला के साथ विकसित किया गया था। संविधान में कहीं भी मूल संरचना का वर्णन नहीं किया गया है, बल्कि यह समकालीन परिस्थितियों में बुनियादी ढांचे के एक हिस्से के रूप में कुछ भी निर्धारित करने के लिए विद्वान न्यायाधीशों के विवेक पर निर्भर करता है। जैसे 1951 में शंकरी प्रसाद मामले में अदालत ने स्वीकार किया कि जनता की भलाई के लिए मौलिक अधिकारों में संशोधन किया जा सकता है, लेकिन बाद में इसने इसके पहले के विचार को खारिज कर दिया और 1967 में गोलखनाथ मामले में फैसले को उलट दिया और बाद में 1973 में जब केशवानंद भारती ने एक याचिका दायर की जब धर्म के अधिकार और संपत्ति के अधिकार के खिलाफ यह मामला था तब अदालत ने फैसला सुनाया कि संसद संविधान के किसी भी हिस्से में संशोधन कर सकती है लेकिन मूल संरचना को बरकरार रखते हुए। इसके अलावा 1980 के मिनर्वा मिल्स मामले में अदालत ने भी यही विचार रखा और संविधान के उद्देश्यों को बचाने के लिए एक बार फिर इस बुनियादी ढांचे का इस्तेमाल किया।
मिनर्वा मिलों के मामले में कुप्रबंधन के लिए सरकार द्वारा मिलों को ले लिया गया था और इस पर मुकदमा दायर किया गया था और यह मामला था जब अदालत ने एक बार फिर से संविधान के हिस्से के रूप में न्यायिक समीक्षा को अपनाया और सरकार द्वारा 42 द्वारा किए गए संशोधनों को असंवैधानिक घोषित किया I
Basic structure of the constitution. The course speaks about the basic structure of the Constitution of India. It explains how it was developed with a series of cases like the Shankari Prasad case, the Golaknath case and the Kesavananda Bharati case. The basic structure is not described anywhere in the Constitution, rather it is up to the discretion of learned judges to determine anything as a part of the infrastructure in contemporary circumstances. Like in 1951, in the Shankari Prasad case, the court accepted that fundamental rights can be amended for the benefit of the public, but later it rejected its earlier view and reversed the decision in 1967 in the Golaknath case and later In 1973, when Kesavananda Bharati filed a petition against the right to religion and the right to property, the court ruled that Parliament could amend any part of the Constitution but while retaining the basic structure. Moreover, in the 1980 Minerva Mills case, the court took the same view and once again used this infrastructure to protect the objectives of the Constitution.
The mills were taken over and sued by the government for mismanagement in the Minerva mills case and this was the case when the court once again adopted judicial review as part of the constitution and announced the amendments made by the government 42. Constitutional amendment as null and void.
